1. Nature of the Service (Wellness, Not Medical)
PortalKinetic is a self-support and forward-motion tool. It is not professional advice, emergency services, or an emergency tool.
2. Not for Emergencies
PortalKinetic cannot help in emergencies. If you are in immediate danger or in crisis, call local emergency services (911 in the U.S.) or a crisis line (988 in the U.S.). The app does not send emergency alerts or contact anyone on your behalf.
3. Use Your Judgment
The Service is designed to support you, not replace your judgment. Routines, prompts, and AI suggestions are starting points, not instructions. Skip anything that feels wrong for you.
4. AI-Generated Content
Some features generate suggestions using AI. AI can be wrong. Do not rely on AI output for medical, legal, or financial decisions. If you need professional advice, consult a qualified professional.
5. Safety While Using Regulation Tools
Some features include audio, breathing prompts, or regulation exercises. Use these only in a safe place. Do not use while driving. Stop immediately if you feel dizzy, unwell, or overwhelmed.
6. Subscriptions, Billing, Renewals, Cancellation, And Refunds
Paid features may be sold through Apple, Google, Stripe, or another approved billing provider. Subscriptions automatically renew unless canceled before the renewal date. Deleting the app does not automatically cancel a subscription. Refunds are handled according to the applicable app store, payment provider, or PortalKinetic refund policy.
7. Account Security
You are responsible for keeping your login credentials safe. Use a secure password and keep your devices protected.
8. Your Content
You control what you enter into PortalKinetic. Please avoid entering regulated records or protected health information. You are responsible for the content you submit and for using the Service safely.
9. Intellectual Property And No Copycat Use
PortalKinetic and its content, design, workflows, software, names, logos, prompts, methods, and materials are owned by PortalKinetic or its licensors and are protected by intellectual property and other laws.
You may not copy, modify, reverse engineer, scrape, decompile, resell, clone, frame, mirror, or create derivative commercial products from PortalKinetic, except as allowed by law. You may not use PortalKinetic to train, benchmark, develop, or improve a competing product or service without written permission.
10. Acceptable Use
You may not access the Service using bots, scrapers, crawlers, automated tools, or unauthorized APIs. You may not copy the structure, sequence, organization, workflows, prompts, content, visual design, or non-public functionality of PortalKinetic to create a competing product.
11. Beta And Experimental Features
Beta features may be incomplete, unstable, or changed at any time. Do not rely on beta features for emergencies, crisis response, emergency support, or critical decisions. Feedback may be used by PortalKinetic to improve the product without compensation.
12. Organization And Enterprise Use
Organization dashboards are intended for aggregate adoption and workflow insights only. They are not employee surveillance, output scoring, regulated monitoring, or performance evaluation tools.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee uninterrupted or error-free operation, or any specific results.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORTALKINETIC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
15. Changes
We may update these Terms from time to time. If we make material changes, we will update the date above and may provide additional notice in-app.
